Turbo Panels Terms and Conditions

1. Definitions and Interpretation

a) In these terms and conditions, unless the contrary intention appears:

• Goods: Refers to parts and other products supplied by us to you.
• Loss: Refers to any cost, expense, or damage of any kind, including consequential, special, or indirect loss or damage, or any fine or penalty imposed by an authority.
• Personal Information: As defined under the Privacy Law (Privacy Act 1988 (Cth) and associated legislation).
• Services: Refers to vehicle repair services provided by us.
• Vehicle: Refers to the vehicle to which we have provided our services.
• We or Us: Refers to Turbo Panels and its employees, contractors, and affiliates.
• You: Refers to the customer requesting our services or goods.

b) Singular words include the plural and vice versa. A reference to legislation or regulation is a reference to it as amended or replaced over time.

2. Application of These Terms and Conditions

a) When you request our goods or services, you are offering to engage us under these terms and conditions, which we accept by supplying goods or services.

b) These terms apply exclusively, and no other terms are valid unless agreed in writing. These terms represent the full agreement between us concerning the goods or services provided.

c) We may modify these terms by updating them on our website, and continued engagement signifies acceptance of any changes.

3. Personal Information

a) By requesting our services, you consent to us accessing and using your personal information as per our Privacy Policy. If information is withheld, we may be unable to provide services.

b) We handle personal information in line with Australian privacy laws. Please refer to our Privacy Policy on our website for further details on data usage, storage, and disclosure.

4. Payment Terms

a) Payment is due upon receipt of the invoice and must be made in Australian dollars without any deduction. GST applies to all goods and services and is payable alongside the invoice.

b) Late payments incur a 2% interest rate above our overdraft rate, calculated daily on the overdue balance until paid.

c) Any supply of goods or services does not grant you intellectual property rights related to our materials or methods.

5. Service Availability

We make every effort to meet anticipated timelines for repairs; however, these are estimates only. Turbo Panels is not liable for any loss or damage resulting from unanticipated delays.

6. Warranty & Disclaimer

a) We stand by our workmanship and materials. Turbo Panels offers a warranty on repairs for the ownership period of the vehicle, covering defects in materials or workmanship directly due to our work.

b) Our technicians are highly trained to deliver the best possible results. However, we cannot be held responsible for any environmental factors that may affect the job’s outcome, especially when working outdoors. Painting in natural elements may occasionally lead to very fine dust particles becoming part of the finish, despite our best efforts to minimize such risks. Our technician will always recommend the optimal approach to achieve a high-quality result, given the conditions.

c) The warranty covers our work only and does not extend to repairs performed by third parties, wear and tear, exposure-related damage, or subsequent incidents involving repaired areas.

d) Warranty claims require you to cover any claim-related costs.

7. Indemnity

You agree to indemnify us from any loss or liability resulting from your breach of these terms or other actions or omissions by you.

8. Limitation of Liability

a) Except as specified, we are not liable for any loss beyond the scope of this agreement.

b) If required by law, we may choose to repair, replace, or resupply the goods or services in question.

c) Our maximum liability for any loss is limited to the amount you paid for the goods or services.

9. General

a) These terms are governed by the laws of Queensland.

b) Failure by us to enforce any term does not constitute a waiver.

c) The rights outlined here are cumulative with and not exclusive of legal rights available independently.

d) You may not transfer any rights or obligations; we may assign our rights as necessary.

e) If any term here is unenforceable, it will be severed without impacting the rest of the terms.

f) Australian Consumer Law guarantees: If our goods or services fail, you may be entitled to a replacement, repair, or compensation as per applicable consumer rights.
